These Terms of Use constitute a binding agreement between you and Survtapp regarding access to www.survtapp.com and related platforms. By accessing the site or mobile applications, you agree to be bound by these terms, along with our Privacy Policy and Data Processing Addendum.
Agreement to Terms
Survtapp reserves the right to modify these terms at any time. Users are responsible for reviewing updates periodically, as continued use indicates acceptance of changes. You must be at least 13 years old to use our services.
Intellectual Property Rights
The site's content — including source code, databases, software, designs, audio, video, text, photographs, and graphics — is proprietary and protected by copyright and trademark laws. You receive a limited licence for personal, non-commercial use only.
User Registration
You must keep passwords confidential and are responsible for all account activity. Survtapp reserves the right to remove usernames deemed inappropriate or objectionable.
Fees and Payment
Payments are processed securely through Stripe. Sales tax is added as required. All payments are in Canadian dollars (CAD). Survtapp reserves the right to correct pricing errors and refuse orders.
Free Trial
New registrants receive a 30-day free trial. The account remains uncharged, with subscription suspended until upgrade to a paid plan.
Cancellation
All purchases are non-refundable. Users may cancel subscriptions anytime by contacting [email protected]. Cancellation takes effect at the end of the current paid term.
Data Storage & Retention
Account data is stored while subscriptions remain active and deleted within 30 days of expiration. EU Residents: Data resides in AWS EU (Frankfurt) Data Center under GDPR. When users delete data or cancel accounts, the system immediately removes data from primary databases. Weekly backups are retained for 7 days, then permanently deleted.
Subscription Billing
Some services use subscription billing with recurring cycles (typically monthly or annual). Subscriptions auto-renew at cycle end unless cancelled via account management or by contacting support. Survtapp does not store credit card information; Stripe processes all payments.
Referral Program
Survtapp may offer a referral program that lets an existing account (the "referrer") invite others (each a "referee") to sign up using a personal referral link. Participation is optional and governed by the following rules, which form part of these Terms:
- Who is rewarded. Only the referrer earns a reward. The referee receives no referral reward or discount for signing up through a referral link.
- What the reward is. A qualifying referral earns the referrer account credit equal to one month at the referrer's own current plan rate. Because the reward is tied to the referrer's plan, an account on a free plan earns no credit (a $0 plan rate); such a referral is held and only becomes payable if and when the referrer is on a paid plan at the time the reward is issued.
- Credit only — never cash. Referral rewards are issued solely as Survtapp account credit. Credit is non-transferable, has no cash value, cannot be exchanged, refunded, or withdrawn for money, and is applied automatically toward the referrer's next invoice (any unused balance carries forward). Credit expires twelve (12) months after it is issued.
- Qualification and holding period. A referral qualifies only after the referee's account has become a paying customer and their first payment has been retained for a thirty (30) day holding period. If the referee's payment is refunded, charged back, or their account is closed, suspended, or otherwise not in good standing during or after this period, the associated reward will be withheld or reversed.
- Limits. A referrer may earn a maximum of twelve (12) rewarded referrals in any rolling twelve (12) month period.
- Fair use and abuse. Self-referral and referrals to accounts you own or control are prohibited. Survtapp may review, flag, withhold, reverse, or disqualify any referral or reward — and may suspend a participant from the program — where it reasonably suspects fraud, abuse, manipulation, duplicate or re-registered accounts, or any violation of these Terms.
- Changes. Survtapp may modify, suspend, or terminate the referral program, or these referral rules, at any time and for any reason, without liability. Changes do not affect credit already issued and applied.
Prohibited Activities
Users may not use automated means to access the site, engage in unauthorised framing or linking, decompile or reverse engineer software, upload viruses or malicious code, or use the site for illegal purposes. A complete list of prohibited activities is available upon request.
Disclaimer of Warranties
THE SITE IS PROVIDED "AS-IS" AND "AS-AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SURVTAPP DISCLAIMS ALL WARRANTIES — EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
SURVTAPP, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, REVENUE, DATA, OR OTHER DAMAGES FROM SITE USE — EVEN IF ADVISED OF POSSIBILITY. Liability is limited to amounts paid during the one (1) month period before the cause of action.
Governing Law
These terms and site use are governed by Ontario law applicable to agreements made and performed entirely within Ontario, without regard to conflict-of-law principles.
